Welcome to Maple Journey. Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the maplejourney.com website (the "Service") operated by Maple Journey ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Use of Service

1.1 Eligibility

2. Bookings and Reservations

2.1 Making a Booking

When you make a booking through our Service, you are entering into a contract with the travel service provider (such as a hotel, tour operator, or transportation provider), not with Maple Journey. We act solely as an intermediary between you and the travel service provider.

2.2 Booking Confirmation

A booking is confirmed only when you receive a confirmation notice from us or the travel service provider. We recommend that you do not make any travel arrangements until you have received this confirmation.

2.3 Payment

Payment terms are determined by each travel service provider. In some cases, full payment is required at the time of booking; in others, a deposit may be required with the balance due later. You agree to comply with the payment terms specified at the time of booking.

2.4 Cancellations and Refunds

Cancellation and refund policies vary by travel service provider and are specified at the time of booking. Some bookings may be non-refundable or subject to cancellation fees. You are responsible for reading and understanding these policies before making a booking.

If you need to cancel a booking, you must do so through our Service or by contacting us directly. Cancellations made directly with the travel service provider may not be recognized by our system.

2.5 Changes to Bookings

If you need to change a booking, please contact us as soon as possible. Changes are subject to availability and may incur additional charges as determined by the travel service provider.

2.6 Travel Documentation

You are responsible for ensuring that you have all necessary travel documentation, including valid passports, visas, and health certificates. We are not responsible for any consequences resulting from your failure to possess appropriate documentation.

3. Intellectual Property

3.1 Service Content

The Service and its original content, features, and functionality are and will remain the exclusive property of Maple Journey and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Maple Journey.

3.2 User Content

By posting, uploading, or otherwise making available any content on our Service (including reviews, comments, and photos), you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, copy, modify, create derivative works from, distribute, publicly display, and publicly perform such content in connection with the Service.

You represent and warrant that you own or have the necessary rights to all content that you post on the Service, and that such content does not violate the rights of any third party.

4. Disclaimers

4.1 Third-Party Services

We do not control and are not responsible for the actions or content of third-party service providers featured on our Service. We provide information about these services as a convenience to our users, but we do not guarantee the accuracy, completeness, or reliability of this information.

4.2 Travel Risks

Travel involves risks. We do not guarantee the safety or suitability of any destination, accommodation, or activity featured on our Service. You acknowledge that you travel at your own risk and are responsible for researching and evaluating the potential risks of your chosen destination and activities.

4.3 Service Availability

We do not guarantee that our Service will be available at all times. We reserve the right to withdraw or amend our Service, and any service or material we provide on the Service, in our sole discretion without notice.

4.4 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MAPLE JOURNEY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

5. Limitation of Liability

IN NO EVENT SHALL MAPLE JOURNEY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
  • ANY CONTENT OBTAINED FROM THE SERVICE; AND

IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT ALLOWED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

6. Indemnification

You agree to defend, indemnify, and hold harmless Maple Journey, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
